RIGHT TO MANAGE
It is common for lessees of blocks of flats or conversions to be unhappy about the management or condition of their buildings. This can arise as a result of high service charges or proposed major works. One way of attempting to deal with this situation is for the Lessees to exercise their statutory right to manage their building (subject to certain pre-conditions) through a right to manage company. It is important to bear in mind that this is a right – the Lessor doesn’t have to be at fault. It should also be borne in mind that the procedure does not involve an application to the court.
