Development & Reconstruction
Commercial and residential property development in London and elsewhere has brought to the fore legal issues that may previously have been regarded as fairly esoteric. Rights of light and rights in relation to party walls are obvious examples. Dewar Hogan has been advising and representing clients on these and other development issues for many years. Unlike the vast majority of law firms we focus exclusively on property issues and disputes, and in relation to property development and reconstruction we are regularly consulted about the following:-
While all the firm’s lawyers are experienced in dealing with these issues two of our lawyers stand out.
John Cox is one of the most well-known and respected party wall lawyers. He leads on most of our most of our party wall work, including regularly acting in appeals of awards. John has also lectured on behalf of the RICS and writes on the subject.
Jim Cotter is a well-known lawyer in the world of rights to light. He has represented both claimants and defendants, including major developers, in disputes and litigation involving claims for injunctions and substantial damages. These have included disputes relating to landmark buildings in the City of London and negotiations with Local Authorities regarding the use of statutory powers to override rights to light. He has also registered and contested light obstruction notices and represented many clients in negotiations for deeds of release of rights to light. Jim has also presented seminars on these subjects, including in-house training to rights to light surveyors.
The firm has close connections with surveyors and barristers who specialise in neighbourly matters such as rights of light and party walls issues.
